At Elexbig, we're committed to protecting both our vendors and customers by maintaining a marketplace built on trust and authenticity. All products sold on Elexbig must be genuine, and vendors must respect intellectual property rights at all times.

What Counts as Counterfeit or Unauthorized Products?

Counterfeit or infringing products include:

  • Fakes or replicas designed to imitate branded goods
  • Unauthorized "dupes" that misuse logos, names, or packaging designs
  • Unlicensed merchandise featuring characters, trademarks, or copyrighted material
  • Misleading branding that suggests association with a company or creator without permission

Important: Any counterfeit or unauthorised branded products listed on Elexbig will be removed immediately. Repeat violations may lead to permanent account suspension.
Rules on Brand Names and Trademarks

Understanding how to properly use brand names helps you stay compliant while accurately describing your products.

When You Can Use Brand Names
  • You may only use a brand name in your listing if your product is genuine and you are authorised to sell it
  • Brand names cannot be used as keywords, tags, or in descriptions unless they truthfully describe the product
  • Do not compare your product to another brand in a way that misleads customers (e.g., "Better than [Brand X]")

    Describing Compatibility

Tip: You may describe compatibility in clear, non-misleading terms (e.g., "Charger suitable for iPhone 14") but must not imply official endorsement or affiliation.
    When describing compatibility:
    • Be factual and specific about what devices or products yours works with
    • Use phrases like "compatible with," "suitable for," or "designed for use with"
    • Make it clear your product is not made or endorsed by the brand mentioned

      Copyrighted and Creative Works

You cannot list items that infringe copyright, including:

      • Pirated books, films, software, or digital content
      • Accessories, or décor using copyrighted images or designs without permission
      • Music or media distributed without appropriate licences
      • Unauthorised use of copyrighted characters, artwork, or logos

Pro Tip: If you create custom or handmade items, consider registering your own intellectual property to protect your designs and brand identity. This gives you legal protection and adds value to your business.
      How to Prove Authenticity

If Elexbig requests proof of authenticity, you may be required to provide:

      • Invoices or receipts from authorized suppliers or wholesalers
      • Licensing agreements or distribution rights documentation
      • Certificates of authenticity from recognized sources or brand representatives
      • Purchase orders showing direct transactions with authorized distributors

Important: Failure to provide proof of authenticity when requested can result in immediate product removal and account penalties. Keep all documentation organized and readily accessible.
      Steps to Stay Compliant

Follow these best practices to maintain compliance with Elexbig's authenticity standards:

      1. Source responsibly: Purchase products only from authorized distributors or directly from brands
      2. Verify your suppliers: Research and vet your suppliers to ensure they provide genuine products
      3. Avoid unauthorized branding: Don't use brand names or logos in listings unless selling genuine products
      4. Maintain documentation: Keep invoices, agreements, or certificates as evidence of authenticity
      5. Create original content: Write your own product descriptions and use your own images
      6. Respond promptly: Address any IP violation notices or compliance requests immediately
      7. When in doubt, ask: Contact Elexbig support if you're unsure about a product's compliance

What Happens When IP Rights Are Violated

Elexbig takes intellectual property violations seriously to protect rights holders and maintain marketplace integrity:

        1. Investigation: We review reports from rights holders and examine flagged listings
        2. Documentation request: You may be contacted to provide supporting documentation
        3. Listing removal: Infringing products are removed immediately
        4. Account review: Repeated violations may result in warnings, restrictions, or permanent suspension

          Frequently Asked Questions

Can I sell "inspired by" or replica items?

No. Products marketed as "replicas," "dupes," "inspired by," or similar terms infringe intellectual property rights and are strictly prohibited on Elexbig.

Can I use a brand name to describe compatibility?

Yes, but only in a factual, non-misleading way. For example, "case suitable for Samsung Galaxy S24" is acceptable. You must not imply official endorsement, partnership, or that your product is made by that brand.

What if my supplier provided counterfeit goods without my knowledge?

You are responsible for ensuring all products you list are authentic. Counterfeit items will be removed regardless of intent, and repeated violations may lead to account suspension. Always vet your suppliers and request proof of authenticity before listing products.

How does Elexbig handle IP complaints?

When we receive a complaint from a rights holder, we investigate promptly and remove infringing listings. Vendors are contacted for supporting documentation and given an opportunity to respond. We take a fair but firm approach to protecting intellectual property.

Are fan art or custom designs allowed?

Only if they don't infringe existing intellectual property rights. Using copyrighted characters, names, logos, or distinctive designs without permission is prohibited, even in custom or handmade items. Original artwork and designs are always welcome.

What about vintage or second-hand branded items?

Genuine vintage or second-hand branded items may be sold, provided they are authentic. You should accurately describe the item's condition and origin and be prepared to provide proof of authenticity if requested.
